Concept
Real estate registration agency refers to personnel who have passed the national unified examination, obtained the "Professional Qualification Certificate for Real Estate Registration Agents of the People's Republic of China" and registered for the record. They work in real estate registration agency service agencies for land and above ground buildings, trees, etc., providing professional services for real estate registration agency business to parties involved. The main responsibilities of a real estate registration agent include handling real estate registration business on behalf of applicants, such as buying, selling, transferring, and mortgaging houses, as well as preparing for the pre registration process, such as investigating, verifying, and processing real estate registration materials. They also assist applicants in resolving issues during the real estate registration process, provide timely feedback on processing results, assist in searching, copying, and verifying relevant real estate registration materials, and provide consultation on legal, policy, and other aspects of real estate registration. The scope of work of real estate registration agents is extensive, including acting as agents for real estate registration applications such as land and above ground houses, trees, etc., conducting boundary and cadastral surveys of houses, trees, etc., and obtaining real estate ownership certificates. They are also responsible for collecting and organizing proof of ownership of real estate and other related materials, assisting in handling procedures related to ownership disputes, lawfully querying real estate registration information, verifying real estate ownership, providing relevant legal advice, and handling other matters related to real estate agency business. With the continuous expansion and activity of the real estate market, the demand for real estate registration is also increasing, providing a broad market and employment prospects for real estate registration agents
Scope of Real Estate Registration
- Residential properties. Residential buildings are houses where people live and are closely related to our lives. Real estate, as a form of real estate registration, allows the government to understand people's living conditions, living standards, and other information, which plays a guiding role in ensuring people's livelihoods.
- Commercial real estate. It refers to properties used for residential purposes, including industrial plants, storefronts, and rental properties, which are subject to appropriate taxation by the government.
- Land. The ownership of land in our country belongs to the state, but the rights to use, develop, collectively own land, contract management, and so on should all be registered. Including forests, grasslands, beaches, mines, pastures, etc.
- Right to use the sea area. The right to use sea areas for development and aquaculture needs to be registered.
- Exploration and mining rights. Exploration and mining rights become objects of real estate registration in non physical form.
Real estate application materials
- Registration application form, original;
- Original and photocopy of the applicant's (agent's) identity certificate;
- State owned land use certificate, original and photocopy;
- Proof that the construction project complies with the plan, original or confirmed copy;
- Proof of completion of the house, original or confirmed copy (quality inspection certificate or completion acceptance record form or proof of completion issued by the quality supervision department, and proof of completion issued by the construction unit for self built houses);
- House surveying and mapping report, original or confirmed copy (if it belongs to the ownership of the building, a report on the definition of the house area also needs to be submitted);
- Proof of house address, original or confirmed copy (proof of house address issued by the civil affairs department);
- For properties such as affordable housing, unit funded housing, low rent housing, and public rental housing, the original or confirmed copy of the project proposal from the National Development and Reform Commission or the Military Region, as well as the approval document from the Provincial, Municipal, or Military Region Housing Reform Office, must be submitted;
- For cooperative construction (joint construction) projects, the original cooperation (joint construction) agreement and property rights division list must also be submitted;
- The construction unit applying for initial registration of the ownership of the jointly owned property by the owners also needs to submit a certificate of confirmation from the planning department of the owner's public property or a written agreement from the owner of the building partition. The certificate of confirmation from the planning department of the jointly owned property by the owners is the original or a confirmed copy, and the written agreement from the owner of the building partition is the original;
- Proof of establishment of special maintenance funds for residential buildings, original.
Real estate registration process flow
- Registration application. Real estate that has not yet been registered and has undergone inheritance, bequest, or changes in property rights shall be registered by the parties at the office of the real estate registration agency.
- Submit materials. Including identification documents of the parties involved, property rights and proof of origin of the real estate.
- Acceptance. After receiving the application, the registration agency needs to verify the property rights information and conduct on-site inspections and verifications of real estate, land attachments, etc. before registering.

- Verify the ownership registration data after converting the coordinate system The provincial department has completed the conversion of cadastral area (sub area) data and 2012 rural collective land ownership registration data from the province to the 2000 national geodetic coordinate system data, and issued it to the natural resources department as the basis for supplementary survey data of rural collective land ownership, serving the third national land survey. After receiving the cadastral area (sub area) data of Dacheng County and the registration data of rural collective land ownership in Dacheng County in 2012, carefully verify to avoid problems such as coordinate point loss caused by software and other reasons that may affect subsequent work.
- Conduct supplementary ownership investigations and inter county border connections Based on the third national land survey in Dacheng County and in accordance with relevant documents such as the "Standard for Real Estate Registration Database (Trial)" and regulations on real estate registration investigation, we will conduct a supplementary investigation of ownership and inter county border connection. The specific contents are as follows: (1) Convert ownership registration data according to the "Real Estate Registration Database Standard"; (2) Conduct a supplementary investigation on the current status of ownership boundaries; (3) Properly handle ownership disputes and ensure inter county border connections.
- Standardize and improve the results of ownership registration The homework technical unit should actively cooperate with the real estate registration department, supplement the real estate unit number, business number, status, file number, registration type, registration reason, district code, etc. in the registration database in accordance with relevant laws and regulations, improve the field content of element code, purpose, owner name, real estate certificate number, registration institution, registrant, etc., and handle the real estate registration of rural collective land ownership for changes in rights. Adhere to the principle of 'no change, no change', rights remain unchanged, and records and certificates remain unchanged.
- Establish an ownership registration database After completing the supplementary investigation of ownership and updating the cadastral area (sub area), supplementing and improving the fields of real estate unit number, business number, etc., establish a rural collective land ownership registration database that integrates spatial data, attribute data, and other archival information, and submit it to the provincial department. Convert the real estate registration database and platform of Dacheng County in the Xi'an 1980 coordinate system to the real estate registration database and platform in the Dadi 2000 coordinate system for the registration of changes in rural collective land ownership. After being included in the real estate registration platform, the collective land ownership registration database will be updated in conjunction with the daily work of real estate registration, and the cadastral area (sub area) will be regularly updated.
